Lu Snide: first, I'm sorry for your loss.If you are in California here are the steps:Did you inherit the car? Has it been more than 40 days since she passed away? If no probate, then take the title and you need a form REG 5 Affidavit for transfer without Probate. You will sign her name as the executor, beneficiary, trustee.....you check the box that describes your situation. You can get a new title in your name. You also need Statement of Facts REG 256 to be exempt from smog and tax : http://www.dmv.ca.gov/forms/reg/reg256.pdfIf you don't want to wait for a new title, you can sell the car with these documents. I suggest you take the buyer to the DMV or AAA Auto Club and do the transfer with the clerks help....Show more
Sammy Kar: the dead can't write. properly you should have her power of attorney, named in her will about car in question,or be the executor of her estate. however if no problems with siblings or husband i would get a letter from lending institution stat! ing that you made payments, then sell the car, signing the title and registration over to buyer, with your mother's name printed ,yours signed"by".
Mahalia Brindle: until s/he left power of lawyer or will, it is going to could wait until probate takes effect. --- Kasey C, laptop guru in view that Apple II days tricky artwork pays off later. Laziness pays off now.
